ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003
The premises licence holder shall notify the Licensing Authority and all responsible Authorities of each year’s proposals at least six months prior to the event.
Full and detailed consultation will be undertaken by the premises licence holder, with each of the Responsible Authorities and those persons/organisations referred to in the Event Safety Guide issued by the Health and Safety Executive (or any replacement guidance subsequently issued). This will take place through Multi Agency or Safety Advisory Group Meetings (organised by the premises licence holder and the Licensing Authority) in the lead up to the event and during the event itself.
An Event Management Plan containing the detail appropriate to each year's event will be produced and implemented in consultation with, and with the agreement of, the Responsible Authorities through Multi Agency or Safety Advisory Group Meetings. The first draft of the Event Management Plan will be submitted for consideration four months prior to the relevant event with the final version submitted six weeks prior to the relevant event.
A debrief meeting will be undertaken after each event to include all Responsible Authorities and other relevant agencies involved with the event.
For each festival the premises licence holder will produce an Event Management Plan, agreed with the Responsible Authorities which will include names, addresses and telephone numbers of persons/organisations responsible for:
Overall event safety control
Production Manager
Medical and first aid provision
Site management and the structural integrity of all temporary structures
Crowd management, stewarding and parking
Management of car parking
Management of concessions and franchises
Management of camp sites and/or other ancillary facilities (should they be required)
Management of welfare and provision of information
Alcohol Management Plan
Traffic Management Plan
Plans detailing exits, entrances, vehicular routes, event arenas, and ancillary areas (e.g. car parking, camp sites etc.) and all facilities will be provided. The design of the site layout may change within the licensed areas but precise and specific plans will be contained within each year's Event Management Plan. The final plans will show temporary structures, stages, sponsor activities, bars, toilets, drinking water facilities, showers, car parks and camping.
The premises licence holder will appoint an Event Safety Advisor, who shall be of sufficient competence, status and authority to advise the premises licence holder effectively on safety at the event and for authorising and supervising safety measures, in consultation with representatives of the Responsible Authorities, on the premises licence holders behalf. The Event Safety Advisor will have a deputy, of similar competence, status and authority to assist him/her and provide cover for any overnight periods of the event. either the Event Safety Advisor or the nominated deputy will be available on site throughout the event. The identities and contact details of the Event Safety Advisor and Deputy shall be provided prior to the event, within the Event Management Plan.
The premises licence holder will appoint a nominated event organiser to be in overall charge of the event and he/she, or his/her nominated deputy, or deputies shall be available on the licensed site throughout the event. The event organiser or his/her deputies will not engage in any duties that prevent them form exercising general supervision and control of the event.
Authorised officers of the Licensing Authority and the Responsible Authorities for the purposes of the Licensing Act 2003, who are in the course of their duties, will be given access to all parts of the licensed site, for the purposes of monitoring and enforcing the observance of any conditions imposed and other relevant legislation.
Officers of Lancashire Emergency Services will be given access to the licensed site in order to carry out their duties, as will officers of any other emergency service assisting them. The premises licence holder will provide an Event Control Centre where one person from each of the Responsible Authorities will be offered a place so as to maintain a presence on site to ensure good communication between all Responsible Authorities and the premises licence holder during the event.
The premises licence holder will make adequate provisions for monitoring and controlling the number of persons entering the licensed site and any temporary structures within it. The premises licence holder shall make all necessary arrangements by way of fencing, gate systems, security or other provisions to prevent unauthorised access to the licensed site.
The Designated Premises Supervisor (DPS) will be on site at all times the premises licence authorises the retail sale of alcohol or will appoint a deputy to be present in their absence who is a personal licence holder.
The premises licence holder will appoint, to the satisfaction of the Responsible Authorities a competent security/stewarding provider.
The premises licence holder will request the attendance of Lancashire Police to provide Special Police Services at each year's event. If Lancashire Police are unable or unwilling to provide the requested service, the premises licence holder may provide additional security/stewarding resources to ensure the safety of all attendees.
A Crime Reduction Policy will be supplied by the premise licence holder and signed by all relevant parties.
A full security/stewarding plan will be produced and contained within the Event Management Plan. All security/stewards will be easily identifiable, have the appropriate training and where appropriate hold licences for their respective duties. The plan will include details of numbers and deployment of security/stewards. A register will be maintained of all stewards and security staff employed before, during and after the event, containing their full names, dates of birth, home addresses, employers, event specific identification names, numbers or codes and where appropriate, their SIA registration details.
CCTV will be installed around the site to the agreed level contained in the Event Management Plan for each event and will be used during the event to monitor activity in agreed key areas.
The alcohol management plan will set out procedures to minimise any contribution to crime and disorder arising from the consumption of alcohol.
Livewyre Festival Ltd will promote the "Drink Aware" campaign to promote safe drinking which will include a dedicated page and link from the Livewyre website and awareness posters within the licensed premises.
During the Livewyre Festival the organisers shall actively encourage the "Challenge 21" Policy whereby if a person looks under 21` they will be asked to produce a form of ID by a member of security or service staff. Suitable forms of ID are as follows:

All drinks will be served in either plastic bottles or collapsible cups in the area for licensable activity. No glass containers shall be sold or distributed in the licensed site. Glass bottles may only be used in such areas as Backstage, VIP/Guest areas and in bars such as a Champagne Bar where in all cases appropriate control measures will be put in place so as not to allow glass to be taken into the main public arena.
The Alcohol Management Plan, which forms part of the Event Management Plan, will specifically address the measures that will be taken to dissuade and prevent persons under the age of 18 from buying, attempting to buy or attempting to secure the supply of alcohol during the event.
The premises licence holder will liaise and cooperate with Lancashire Police and Local Authority Licensing Officers on the monitoring of the sale of alcohol during the event.
An Illegal Substances Policy and Management Plan will be produced for each year's event. This Plan will contain the policy for discouraging the use of illegal substances at the event. Procedures for searching and confiscating illegal substances will also be contained within this Plan.
Security Officers shall be tasked to make active observations for illegal use of drugs on the event site. There is the right to search the attending public prior to entry.
Searches for drugs will be intermittent on entry. Experienced security officers shall be positioned at entry points to observe and select attendees for search.
Any drugs found on the site or on search shall be bagged and marked with signature, name, time and date of seizure; to keep a continuity for evidential purposes, secured bags shall be held in the drugs safe of the medical coordinators ambulance for safe keeping until the handover to Lancashire Constabulary officers.
Any information or intelligence regarding illegal drug supply on the site will immediately be passed on to officers of the Lancashire Constabulary, if they are present.
Information shall be passed to the public via websites, ticket conditions and signage and to workers via contracts of employment and terms & conditions.
Appropriate arrangements by way of fencing, gate systems, security or other provisions will be made, in agreement with Responsible Authorities, to prevent unauthorised access to the site.
SIA Officers shall staff all entrance points.
Security Officers shall patrol the site 24 hours per day from the moment the organisers take control of the site.
SIA Officers shall be contracted to patrol the site to deter and deal with drunken and violent behaviour.
The organisers shall carefully design tickets/wristbands to prevent copying for fraudulent persons.
Livewyre Festival Ltd shall supply details of the security contractor and officers to the licensing authority and Lancashire Constabulary at least 14 days prior to the event to assist with ensuring the quality and service of security personnel.
When arena entrances are first opened a line of stewards shall be placed strategically across the arena to prevent rushing and to avoid tripping accidents. Public address announcements shall be made in the interests of public safety.
Stewards shall assist in the management of the crowd with a view to filling the arena evenly to prevent overcrowding.
A front of stage barrier system of "Mojo" A-Frame type shall be installed for the concerts. This barrier system shall be procured, designed and installed in accordance with the recommendations of HSG 195 and the IStructE publication "Temporary Demountable Structures; Guidance on Design, Procurement and Use" (Third Edition, 2007).
If the event fails to sell out in advance no tickets may be sold from the licensed site. Details of this will be advertised on any website or other promotional material.
The premises licence holder will appoint a suitably competent organisation to manage and provide suitably manned and equipped medical/first aid facilities on site to the satisfaction of the Responsible Authorities.
In order to ensure that emergency service access and egress routes are maintained the premises licence holder will prepare a Traffic Management Plan in liaison with and to the satisfaction of the relevant Responsible Authorities. This plan will also include any car parking arrangements.
Nominated emergency access and egress routes will be kept clear at all times.
Should any festival include the provision of campsite facilities, a full Campsite Management Plan will be included in the Event Management Plan. This will include the structure of the campsite management team, capacities of each campsite, campsite layout and fire lanes, schedule of operation, position of any campsite viewing towers, campsite facilities and fire cover facilities.
The premises licence holder will create a Welfare Area within the licensed site and will appoint designated stewards with expertise in Welfare at large scale outdoor events to be present within the area.
Should a child be brought to the attention of stewards/security, the child will be taken to the Welfare Area, details of the child and its location will be passed to the Event Control Centre.
All staff operating at the Livewyre Festival shall receive induction relevant to child protection, relevant legislation and reporting of accidents.
Staff shall be made familiar with the Child Protection Policy and Code of Behaviour.
At no time shall a lost child be left in the sole care of a single person.
The Lost Child area and all lost children shall always be accompanied by two members of staff.
The Lost Child Point shall be clearly advertised as a collection point for lost children.
If an announcement has to be made via the PA system, there shall be no reference to the children specifically and personal details, descriptions or names shall not be given.
If a child is reluctant to go with a parent or adult collecting them then a second opinion must be sought from the Lancashire Constabulary.
No Performer or Presenter at the Livewyre Festival shall include any offensive language in their stage performance.
There shall be no offensive language spoken via any PA or microphone from the stage or any part of the licensed site.
No offensive language shall be used on the Livewyre Festival Ltd's website.
All performers and presenters at the Livewyre Festival shall be made aware of this Policy and shall agree to it prior to their performance.
The Premises Licence Holder shall ensure that all events and activities held at the site will follow the guidance issued in HSG195 The Event Safety Guide and any other relevant legislation and guidance.
The Premises Licence Holder shall ensure that the Event Organiser submits an event specific event management plan to the satisfaction of the licensing Authority at least 28 days prior to each event. The Event Management Plan and associated documentation (including site plan) must be clearly labelled indicating version number and date of publication.
Structures and Barriers
The Premises License Holder shall ensure that all temporary demountable structures including, marquees, barriers, grandstands, towers and any other relevant structure conform to The Institution of Structural Engineers “Temporary Demountable Structures - Guidance on Design, Procurement and Use” (3rd Edition, 2007) and to recommendations in HSG 195 The Event Safety Guide
Pyrotechnics and Special Effects
No authorized exhibition, demonstration or display of fire, laser equipment, fireworks, heated fogs, cryogenic fogs, mechanical fogs, strobe lights, pyrotechnics or other special effects shall be given in the licensed site without the prior consent of the Licensing Authority
All pyrotechnics and special effects shall be operated in accordance with guidance in the Event Safety Guide and any other relevant guidance and legislation.
Risk assessments covering pyrotechnics and special effects shall be made available to all relevant Responsible Authorities prior to the event
LPG
The Premises License Holder shall ensure that any LPG brought onto site by traders or other catering operations is handled and stored in accordance with current regulations and codes of practice;
Electrics
A completion certificate completed by an appropriately qualified and experienced person, declaring that all electrical installations at the site are installed, tested and maintained in accordance with the latest edition of the installation of Electrical Engineers’ Regulations for Electrical installations (the IEE Wiring Regulations) shall be provided to the Licensing Authority prior to the festival and a copy kept on site with the person in control of safety
Food safety
The Premises Licensee Holder shall ensure that only premises that are already registered under the Food Hygiene (England) Regulations 2006 shall be allowed to provide food at the event
The Premises Licence Holder shall ensure details of all catering establishments who are to attend the event are submitted on the to Environmental Health, Food Safety Team on the Councils’ Event Catering Forms no less than 28 days before the event
Funfair and Other Attractions
The Premises Licence Holder shall use all reasonable efforts to ensure that any side-show, ride or other attraction being provided in relation to the event is safe. Details of such attractions shall be provided to the Licensing Authority no less than 28 days prior to the event and shall contain the operator’s risk assessments, method statements, engineer’s inspections reports and insurance details. The location of such attractions shall be indentified on the site plan
Sanitary Accommodation
The Premises Licence Holder shall ensure that adequate provision for sanitary accommodation and hand washing facilities is made for the number of people expected to attend the event, and that consideration is given to location, access, construction, type of temporary facilities, lighting and signage.
