ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003
Each pre-planned event shall be risk assessed in relation to each licensing objective and where appropriate advance liaison with the Divisional Police Licensing Officer shall take place.
There shall be no full nudity or entertainment of an adult nature.
No person in possession of an alcoholic drink in an unsealed container shall be allowed to enter the premises.
Notices shall be displayed to inform patrons not to leave the premises with alcohol in an unsealed container and staff shall deter patrons from leaving the premises with such container.
Where an event is considered of raised risk, only alcohol containers made of toughened, polycarbonate or of glass compound constructed to minimise injury when broken will be used to dispense beer products.
Staff shall regularly patrol the areas of the premises to deter unlawful activity and prevent empty drink container and glass build up.
The premises shall have appropriate CCTV coverage in accordance with Lancashire Constabulary technical requirements for licensed premises CCTV systems.
On the occasion of a football match in the town, the premises shall curtail licensable activities if requested by a senior police officer without the requirement for a closure order under Section 161 of the Licensing Act 2003.
Staff shall receive regular training to prevent unauthorised sales to drunken persons, underage persons and to promote the licensing objectives.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
Before the premises are opened for the purposes authorised by the licence each day, an inspection shall be carried out to ensure that they are safe for use.
A risk assessment under the Fire Safety Order shall take place and regular training shall take place in relation to emergency producers.
Prior to the premises first public use after construction, emergency services familiarisation opportunities and practice evacuation and emergency lighting testing will take place.
All exits and escape routes to those exits (including external escape routes) from the premises shall be provided with non-slip even surfaces and shall be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises. External escape routes shall also be kept free from ice and snow.
The furniture or seating in premises shall be arranged so that it does not obstruct any exit, route to any exit or to any emergency facility within the premises.
On every occasion before the public, members or guests are admitted to the premises an inspection of all normal and emergency lighting shall take place. A record shall be kept in a logbook of those tests and any faults discovered together with a record of the work carried out to repair those faults. All faults discovered shall be repaired immediately or if that cannot be done then as soon as is possible and the reason for the delay shall be entered in the logbook.
All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency or access and egress purposes.
The premises will be constructed to prevent avoidable noise escape.
The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly.
No transfer of waste of bottles etc. likely to produce noise from the premises into external trade waste bins shall take place between 2300 hours and 0800 hours.
Half an hour before the premises are due to close, music shall be played at a significantly lower volume and tempo in conjunction with a wind down and dispersal strategy.
The licensee shall ensure that staff arriving early morning or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
There shall be no emission from the premises of any offensive smells, which are likely to cause a nuisance.
There shall be provided at the premises containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.
Statutory obligations and risk assessments under the Control of Noise at Work Regulations 2005 and Section 84 and Schedule 1 of the Clean Neighbourhoods and Environment Act 2005 will be conducted.
No nuisance shall be created by the transmission of noise through the structure of the building within the licensed area which would affect nearby residential properties.
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 21 years to produce one of the following forms of identification:
A recognised proof of age card accredited under the British Retail Consortiums
Proof of Age Standards Scheme (PASS)
Passport
Citizen card supported by the Home Office
Official ID card issued by HM Forces or European Union bearing a photograph and
birth of the holder
Notices shall be displayed at the entrance and inside the premises indicating that it is unlawful for persons under the age of 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
No person under the age of 18 years shall be allowed to enter the premises unless accompanied by a person of 18 or over.
No child under the age of 14 shall be allowed in the premises after 22.00 hours unless attending a pre-booked function to which the general public shall have no access.
The Code of Practice for Gaming Machines in Alcohol Licensed Premises produced by the Gambling Commission June 2007 shall be implemented.
