ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003
Maximum number of people including staff and performers allowed to be on premises at any one time shall be 200.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours are as stated in Part A and include;
On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December).
the Permitted Hours restrictions do not prohibit:
(a) removed
(b) removed
(c) removed
(d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(f) the sale of alcohol to a trader or club for the purposes of the trade or club;
(g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(h) the taking of alcohol from the premises by a person residing there; or
(i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
All exit doors shall be checked daily to ensure they function satisfactorily, Records shall be kept of all checks and be available for inspection when required.
All removable security fastenings shall be removed from doors whenever the premises are open to the public.
All fire doors shall be maintained effective.
Steps and stair edges shall be appropriately highlighted so as to be conspicuous.
Curtains, hangings and temporary decorations shall be located so as not to obstruct exits, fire safety signs or fire fighting equipment.
Notices detailing action to be taken in the event of a fire or other emergency shall be prominently displayed and maintained in good condition.
Fire drills shall be conducted monthly and records kept for inspection on request
An evacuation policy shall be in place that is to the satisfaction of the Fire Authority. All staff members shall be trained in the evacuation policy.
All exit doors shall open outwards, apart from the main front door which shall be secured open when the premises are open to the public.
Adequate and appropriate first aid equipment shall be available on the premises.
In the absence of adequate daylight, suitable and sufficient lighting shall be provided and maintained in any area accessible to the pubic.
Fire safety signs shall be adequately illuminated.
The premises shall have a satisfactory NICEIC or ECA periodic electrical installation report. An inspection shall be carried out each year and a new report requested each time
The premises shall have a satisfactory NICEIC or ECA periodic emergency lighting report. An inspection shall be carried out each year and a new report requested each time.
The premises shall have an OFTEC certificate of inspection in respect of the oil filled boiler. An inspection shall be carried out each year and a new report requested each time.
The premises shall have suitable public liability insurance to the sum of £5 million. A certificate shall be obtained each year and displayed on the premises.
Portable fire fighting equipment shall be inspected annually and a certificate obtained each time.
Any temporary electrical installation being used shall be checked by a NICEIC or ECA electrician and a temporary installation report or a certificate of compliance with BS7909 shall be obtained.
If any alteration to the premises is to take place that makes it impossible to comply with an existing condition, a variation of the premises licence shall be sought. A new operating schedule shall be produced reflecting the proposed alteration and what alternative steps will be taken to promote the public safety objective.
Signs shall be prominently displayed requesting customers to leave the premises quietly and have regard for residential neighbours.
Sign shall be displayed that request customers to call for taxis from within the premises and request taxi drivers to come into premises on arrival and not to sound their vehicle horn.
The DPS or other responsible person nominated by him shall ensure that the level of noise emitting from the premises shall be kept to a minimum by regulating the noise from within the premises.
Only glasses which are made from toughened/safety glass or plastic shall be used when alcohol is being consumed in any area outside the premises which trades as part of the premises.
No drinks shall be sold for consumption in either glass bottles or any other vessel or container made of glass in the outside area. Any drink will be either served in a bottle, which is not made from glass or alternatively will be decanted into a plastic container or vessel before being given to the customer.
Any person who appears to be under the age of 21years shall be asked to provide identification that they are over the age of 18 years. The only acceptable forms of identification are;
UK photo driving licence
Passport
PASSS card (proof of age standard scheme)
Proof of age checks shall take place inside the premises by staff whenever they have doubt about a person’s age.
Notices publicising the challenge 21 initiative shall be clearly displayed behind the bar area at all times.
