ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003
A member of management will always be on duty and if required on busy occasions two managers will present.
A CCTV system will be maintained working at all times.
Capacity limits for the premises are as follows, Farriers Loft x 50, Pendle Suite x 120, Lindsay Suite x 60, Lounge x 100, Smithies café/bar
Staff will regularly carry out Fire procedures and checks and maintain a log of these tests.
Signage will be prominently displayed at all exits to the premises asking people to leave quietly and to have regard for residential neighbours.
The door which serves Linsey Street shall be kept closed (except for access) in order to minimise noise emitting from the premises.
Gaming machines will be located within sight of the bar and be closely supervised. Notices stating, "No under 18's allowed to play" (or similar) will be prominently displayed next to the machine.
A Challenge 21 scheme will operate in the premises - any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
UK photo driving licence, Passport, PASS card (proof of age standards scheme)
Any person unable to prove their age will be refused entry without exception. Proof of age checks will take place inside the premises by staff whenever they have doubt about a person's age.
At all times the DPS or other responsible person nominated by him shall ensure that the level of noise emitting from the premises shall be kept to a minimum by regulating the noise from within the premises.
On occasions when children's functions (e.g. Christmas parties) take place, the bar area shall be closed and the appropriate number of adults will be present to supervise and ensure the safety of the children,
Cigarette machines will be located in a well-supervised position.
Information about local taxi services or other means of transport to assist customers to return home will be readily available. In Burnley town centre reference will be made to the Home safe Initiative.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours are as stated in Part A and include;
On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December).
The Permitted Hours restrictions do not prohibit:
(a) removed
(b) removed
(c) removed
(d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(f) the sale of alcohol to a trader or club for the purposes of the trade or club;
(g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(h) the taking of alcohol from the premises by a person residing there; or
(i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
