Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  No supply of alcohol may be made under the premises licence -

   

  (a) At a time when there is no designated premises supervisor in respect of the premises, or

  (b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

  Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Use of door supervisors.

  Each individual in the premises who carries out a security activity must be licensed by the Security Industry Authority unless the premises or part of the premises where they are present is being used wholly or mainly as a restaurant or guest house, for theatrical performances or plays, or a Gaming Licence is for the time being in force in respect of those premises.

• ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003

   

  All external doors and windows shall be kept closed save for entrance and exit purposes when amplified music is being played.

   

  A sign shall be prominently displayed at the exits requesting customers to leave the premises quietly and with consideration to neighbours.

   

  The DPS or representative shall monitor and record noise levels whilst amplified music is being played.

   

  The Permitted Hours restrictions do not prohibit:

  (a) removed

  (b) removed

  (c) removed

  (d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

  (e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  (f) the sale of alcohol to a trader or club for the purposes of the trade or club;

  (g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  (h) the taking of alcohol from the premises by a person residing there; or

  (i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or

  (j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  Fire alarms shall be inspected twice yearly, and emergency lighting tested weekly and records of checks maintained.

   

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours are as stated in Part A and include;

  On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December).

   

  No person under 16 years shall be permitted on the premises after 22.00 hrs, except for Christmas Eve & New Years Eve

   

  Anyone appearing to be under 18 years shall be asked to provide proof of age before any sale is made.

   

  The beer garden/external areas of the premises shall be closed to customers at 22.00hrs.

   

  No irresponsible drinks promotions shall be undertaken in respect of the premises.

   

  No customers carrying open or sealed bottles shall be admitted to the premises at any time the premises are open to the public

   

  All fire doors shall be maintained effectively self closing and shall not be held open, other than by approved devices

   

  Notices detailing the actions to be taken in the event of fire or other emergencies, including how the fire brigade shall be summoned, shall be prominently displayed

   

  A competent person shall undertake annual inspection of gas and electrical installations.

   

  The occupancy limit for the licensed premises shall be 180.

   

   

• ANNEX 3 - Conditions attached after a hearing by the licensing authority

   

  Smoking shall be prohibited from the front of premises facing Brownside Road at all times.

   

  The premises shall adhere to the following Dispersal Policy:

   

  The purpose of this Dispersal Policy is to ensure, so far as it is possible, that minimum disturbance or nuisance is caused to our residential neighbours and to ensure that the operation of the premises takes makes the minimum impact upon the neighbourhood in relation to potential nuisance and anti-social behaviour.

  
  This will be achieved by exercising pro-active measures towards and at the end of the evening.

   

  By ensuring that this Dispersal Policy document is brought to the attention of Management and Staff we will seek to encourage the efficient dispersal of our patrons during our closing period.

   

   

  1.              1. Music - consideration will be given to the volume levels, type of music played coupled with  

            the usage of lighting levels designed to encourage the gradual dispersal of patrons during the

            last part of the evening.

   

      Fifteen minutes before the terminal hour a slower tempo style of music will be played.

   

  2.              2. Staff Members (including door personnel) will advise patrons to leave the premises quickly 

            and quietly and to move away from the area out of respect for local residents.

   

  3.              3. Notices will be displayed requesting our customers to leave quietly and in an orderly manner

            out of consideration to neighbours and their attention will be drawn to these notices by

            members of staff (including door personnel)

   

  4.              4. At the end of the evening we will ensure the removal of all bottles and glassware from any 

            patron before exiting the premises.

   

  5.6              5. We will actively discourage our customers from assembling outside the

            premises.

   

  6.              6. We will come to an arrangement with a private hire taxi firm whose telephone number will be

            prominently displayed within the premises for customers use on the basis that such company

            will operate a ring back system and not sound horns when collecting their fare.

   

  7. Consideration will also be given to staff departures. Staff will be instructed to leave the

      premises quietly and to request that any waiting taxis do not leave their engines running or

      sound their horns whilst waiting.
