ANNEX 2 - Conditions Imposed in Accordance with the Operating Schedule & Under Paragraph 18(4) & 18(5) Schedule 8 Licensing Act 2003
The premises operates until 11pm with approximately 24 covers for internal dining customers and also provides an external delivery service with online and
telephone orders. A takeaway delivery service only shall operate for customers after 11pm up to 2am. There will be no provision for indoor dining and ordering after 11pm as this will be delivery only.
The premises currently operates without issue and has a healthy relationship with the immediate neighbours. Their location is within the Burnley Town Centre
boundary on a commercial street with a few other hot food and takeaway premises that also open until 11pm.
Staff shall be fully trained in customer service with at least one first aider on the premises at any one time and the premises and areas surrounding shall be kept clean and
tidy with the provision of bins in close proximity to deter littering.
CCTV is installed at the premises with a fully operational alarm system for the security and safety of the premises and those using it.
Fire prevention, protection and fighting equipment are available on the premises with staff trained to deal with any emergencies as appropriate. Warning signs for exits and steps up into the premises are clearly visible for customers with only staff members allowed in storage and kitchen areas with signs and physical barriers for indication to customers.
The premises is small with around 24 seats inside to the front for customers staying to eat in. All customer areas can be supervised by fully-trained staff members with at least two members on the premises at any one time to monitor activities. The limited number of customers allowed on site means there is less chance of crime and disorder occurring, and should it occur there are wary and adequately trained staff available to deal with the situation.
CCTV is installed throughout the premises with a security alarm system and physical metal shutters for the shop access and windows to secure the property when closed and to protect staff and customers.
Any recommendations from the Police will be taken on board by the business to further help prevent crime and disorder.
The premises currently holds a 5 star Food Hygiene rating and will continue to strive for the best cleanliness and hygiene of the premises as per the guidance from Environmental Health for public and customer safety.
The CCTV and presence of staff on site shall assist in public safety both as a deterrent for hazards and reaction to hazards as they happen. Risk assessments and Health and Safety checks are done regularly to ensure any new risks or issues can be dealt with appropriately and keep the public safe.
Staff are on hand to deal with any reports of safety issues with warning signs and other provisions to prevent usage of areas that may be hazardous such as wet floor signs and using the furniture to block off areas not to be accessed by customers. The main area of hazards will occur in the kitchen which is blocked from customer access by the physical barrier of the ordering counter
The premises currently do not cause any public nuisance and wish to continue this. The late opening hours after 11pm will be limited to takeaway with delivery orders only as there will be no access for customers on the premises after 11pm. This will help to lower any potential for public nuisance to occur.
Staff members on site are fully trained in customer service and will know how to deal with any nuisance that may occur at the premises in a calm and orderly fashion. The licence holder has a confident and healthy relationship with the neighbours shall be approachable should there be any nuisance caused that needs to be dealt with.
The volume of any background music and sound from the live sporting broadcasts will be monitored and kept to an appropriate level so as to not to disturb any nearby neighbours.
There should not be any activities on site that should harm children- should there be any that arise these will be reported to the relevant authorities and a risk assessment will be completed to prevent it from happening again.
Children under 10 will not be served unless with an adult to prevent the encouragement of an unhealthy diet. The menu of the business does provide smaller options for children with healthier drinks options to promote choice however the main menu and premises is aimed at people aged 16 and over with the branding and appearance to suit.
When showing the live sporting events, there will be limited spaces inside the premises and any children in attendance must be accompanied by an adult at all times.
Any staff under 18 will not be permitted to work after 11pm and those working after 8pm will be provided transport options to ensure they get home safely.
