ANNEX 2 - Conditions consistent with the Operating Schedule
Exit doors must be regularly checked to ensure they operate satisfactorily.
All removable security fastenings are to be removed whenever the premises are open to the public or staff.
Amplified music will be played through a sound limiting device with music controls which will be set at a suitable level agreed by the environmental health officer. This level will be monitored by the licensee and will be inaccessible to the public.
Music will be played at a lower level from 12 midnight. Windows will remain closed when live or recorded music is being played
All exit doors will be operable without the use of a key, card, code or similar means.
All fire doors must be maintained effectively self closing and will not be held open other than by approved devices.
Fire resisting doors to service shafts, ducts and cupboards must be kept locked shut.
Steps and stair edges will be appropriately highlighted so as to appear conspicuous.
Curtains, hangings and temporary decorations must be maintained in a flame retardant condition.
Upholstered seating must be fire retardant and comply with current fire safety regulations.
Curtains, hangings and temporary decorations must be located so as not to obstruct exits, fire safety signs or fire-fighting equipment.
Notices detailing the actions to be taken in the event of fire or other emergency must be prominently displayed and maintained in good condition.
Fire drill and emergency lighting tests will be conducted. Records of these tests will be available upon request.
All fire exits and means of escape must be signed in accordance with BS5499.
An evacuation policy will be in place that is to the satisfaction of the Fire Authority.
Wall and ceiling finishes will be fire resistant to the appropriate standard.
All exit doors will open outwards.
Adequate arrangements will exist to enable the safe evacuation of disabled people in the event of an emergency.
Adequate and appropriate first aid equipment and materials must be available on the premises.
In the absence of adequate daylight suitable and sufficient lighting will be provided and maintained in any area accessible to the public.
Fire safety signs must be adequately illuminated.
Emergency lighting will be installed and must be regularly maintained.
Emergency lighting tests will be conducted monthly. Records of these tests will be available upon request.
RCD emergency cut off switches must be fitted on all entertainment equipment.
The premises will have a satisfactory NICEIC or ECA periodic electrical installation report. A new inspection will be carried out every 5 years.
The premises will have a CORGI certificate of inspection in respect of any gas boiler, calorifier or appliance. An inspection will carried out every 1 year and a new report obtained each time.
The premises will have a certificate of inspection for portable fire fighting equipment. An inspection will be carried out every 1 year.
The premises will have a certificate of inspection for the fire detection alarm. An inspection will be carried out every 1 year.
The Maximum number of persons permitted on the premises shall be;
Ground Floor 60
First Floor 60
The premises will adhere to policy challenge 21 and will accept PASS cards, passports and driving licence as ID. Cigarette machines will be clearly marked for over 16s.
The designated premises supervisor shall have at least one year's experience of managing similar premises with a similar capacity and with a similar terminal hour.
A personal licence holder shall be on the premises at peak times during the day.
A risk assessment will be carried out by a suitably qualified person on behalf of the premises licence/club premises certificate relevant to crime and disorder, public safety, capacity and public nuisance and a copy of which shall be forwarded to the police.
When available, only glasses which are made of 'toughened glass' will be used when alcohol is being consumed outside the premises, which trades as part of the premises.
The premises will maintain and operate a CCTV system, which complies with minimum requirements expected by the Lancashire Constabulary and shall record during all hours that a licensable activity takes place on the premises.
A dispersal policy which is agreed by the police will be implemented at all times.
The premises licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend meetings of any Pub Watch scheme for the area within which the premises operate.
There shall be no off sales made from the premises beyond 11pm.
No persons under the age of 18 will be permitted on the premises after 9.00pm except in the function room.
Any person who lo0ks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following forms are the only forms of ID that are acceptable:
UK photo driving licence, Passport, PASS card.
Notices from the police publicising the Challenge 21 initiative shall be clearly displayed at the entrance to the premises and behind the bar at all times.
Except for the function room, no under 18s discos or parties will be held at the premises.
On occasions when children's functions take place, the bar shall be closed and the appropriate number of adults will be present to supervise and ensure the safety of the children.
Gaming machines will be located within sight of the bar and will be closely supervised.
Notices stating that "no under 18s allowed to play" (or similar) will be displayed next to the gaming machine.
Cigarette machines will be located in a well supervised position.
Notices stating that "it is illegal for persons under 16 to purchase cigarettes" similar will be prominently displayed next to the machine.
As and when the Police deem it necessary the following conditions relating to certain sporting fixtures will apply;
All drinks will be served in plastic glasses without exception.
All glasses or heavy duty ashtrays will be removed and replaced with lightweight plastic.
All other weapons that may potentially be used as weapons e.g. pool cues and pool balls will be removed or secured.
Arrangements will be made for the rubbish skip/bin, containing empty bottles, stored outside the building, to be emptied prior to a designated football match. If this cannot be arranged the licensee should ensure that the container is secured and cannot be accessed by members of the public.
When door supervisors are used on a regular basis at the premises, door supervisors will be on duty before the start and after the match.
The DPS will adhere to closing/opening times on the day a specified sporting fixture is taking place, as decided by the police.
The doors to the premises will be closed at the end of a match as and when requested by the Police.
The beer garden will be closed for the duration of the match as and when requested by the Police.
The DPS will be on the premises at all times.
Free drinking water will be made available at all times from the bar.
A daily incident log book detailing all incidents of note at the premises e.g. slips, accidents, refusals and incidents of disorder etc. The lo shall be a bound book and made available for up to six months to Police or any other responsible authority for inspection, if required.
No drinks will be sold in either glass bottles or any other vessel or container made of glass. Any drink will be either served in a bottle, which is not made from glass or alternatively will be decanted into a plastic container or vessel before being given to the customer.
The premises will use both DJ announcements and other members of staff asking people to leave quietly and having regard for residential neighbours.
The premises will provide signage at all exits to the premises asking people to leave quietly and to have regard for residential neighbours.
There will be readily available information about local taxi services or other means of transport to assist customers to return home.
When regulated entertainment is taking place all external doors and windows must be kept closed.
At all times the DPS or other responsible person nominated by him shall ensure that the level of noise emitting from the premises shall be kept to a minimum by regulating the noise from within the premises.
No supply of alcohol may be made under the premises licence -
(a) At a time when there is no designated premises supervisor in respect of the premises, or
(b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Use of door supervisors.
Each individual in the premises who carries out a security activity must be licensed by the Security Industry Authority unless the premises or part of the premises where they are present is being used wholly or mainly as a restaurant or guest house, for theatrical performances or plays, or a Gaming Licence is for the time being in force in respect of those premises.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours are as stated in Part A and include;
On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December).
The Permitted Hours restrictions do not prohibit:
(a) removed
(b) removed
(c) removed
(d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(e) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(f) the sale of alcohol to a trader or club for the purposes of the trade or club;
(g) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(h) the taking of alcohol from the premises by a person residing there; or
(i) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(j) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
The conditions attached to your Public Entertainment Licence will still apply to your premises unless specifically excluded by this licence.
A copy of the PEL conditions is included as part of your licence.
A minimum of 2 door supervisors who are registered with the SIA shall be on duty from 22.00hrs for the first 100 patrons and thereafter an extra door supervisor for every 100 or part thereof.
Door supervisors shall be positioned at each entrance/exit (other than fire only exits) to ensure that no customer leaves with any glasses or bottles.
